Definition of insurance payment size in case of causing harm tolife and health of injured.

1.In case of causing harm to life or health of injured the lost income of injured which he had or could have for the day of causing harm to him must be compensated. Also additional expenses caused by harm to health including expenses for treatment, additional food, purchase of medicines, prosthetic repair, secondary care, health resort treatment, purchase of special transport means, preparation for another profession must be compensated if it is approved that injured needs these kinds of aid and care and doesn't have for their free reception,

2 For reception of insurance payment in case of causing harm to life or health of injured except the documents noted in paragraph 44 of the present Rules the injured attaches the documents noted in paragraphs 51, 53-56 of the present Rules to the application for insurance payment.

2.1The following document are presented in case of demand for compensation of lost income of injured:

a) medical report depicting character of received injuries, diagnosis, disability period;                  

b) medical - social or legal medical expertise report about the rate of disablement;

c) statement from employer (educational establishment or social agency) about the amount of earnings (income, pension, scholarship) of injured for the period necessary for calculation of compensation;

d) other documents proving incomes of injured which are considered in definition of lost income amount.

3.The amount of compensated lost income by injured is defined in percentage to his average monthly earning (income) before getting injury or harm to health or before his disability corresponding to the rate of disability according to Russian Federation legislation.

4. In case of demanding compensation of harm on account of loss of breadwinner the following documents are presented:

 a) application with enumeration of family .members of the dead and indication

of persons being on his/her (maintenance and having right to get aliment from him/her;    

b) death certificate of the dead in road traffic accident:

c) statement about dead person’s earning (income), pension, permanent alimony, scholarships, other payments (rent, aliment etc.) for the period noted in civil legislation for calculation of harm compensation because of breadwinner's death;

d) birth certificate of a child (children) in case if juvenile children were on maintenance of dead for the moment of insurance event;

e) statement from medical - social or legal medical expertise establishment about invalidity in case if invalids were on maintenance of dead for the moment of insurance event;

f) statement from educational institution about the fact that a family member of dead having right for compensation studies at this educational institution in case if persons studying in educational institution were on maintenance of dead for the moment of insurance event;

g) conclusion (statement of medical establishment, social agency) about necessity of additional nursing in case if persons who needed additional nursing were on maintenance of dead for the moment of insurance event;

h) statement from social agency (medical establishment, local government, employment service) about the fact that one of the parents, marriage partner or another family member doesn't work and is nursing for his/her relatives in case if persons not working and busy with nursing for his/her relatives were on maintenance of dead for the moment of insurance event;
